Introduction
Fairville takes your privacy and your rights in data processing seriously. The purpose of this privacy statement is to inform you about how Fairville collects, processes and uses your personal data, both in general and when you visit our website (www.ourcityapps.com) and/or download or use one of our applications.
The data processing is done in accordance with the General Data Protection Regulation (GDPR) and all other applicable legislation related to privacy and data protection.
Fairville is a software developer that has developed a platform for mobile communication called 'Our City App'. Local authorities (cities and municipalities) can offer Our City App to their citizens so that they can easily communicate with government agencies and local traders.
When Fairville processes personal data via Our City App on behalf of a local government, Fairville acts as a processor within the meaning of the GDPR, and the local government is responsible for the processing. Such data processing is explained in the privacy statement of the relevant government responsible for this processing.
The current Privacy Statement only relates to the processing operations that Fairville itself, as the controller, performs. If Fairville itself processes your data via its Websites or mobile application, and does not act on behalf of a local government or third party, the current privacy statement applies to this.

The following personal data are processed:
- As a user of Our City App, Fairville will manage your profile information. If you do not register anonymously, this may include (your e-mail address, your Facebook account, your itsme profile or your apple ID). Optionally, your name or username, gender, date of birth and profile picture can also be added, as well as location information and friends or contacts.
- As a registered user of our Websites, Fairville will also manage your profile data. These include your name and your email address.
- As a customer of Fairville (such as merchants, associations, local governments, healthcare providers, etc.), Fairville records personal and electronic identification data (name, e-mail address, telephone number) of the contact person with the customer, as well as the credit card details of this customer.
Fairville does not process 'special' or 'sensitive' data, and does not do automatic decision-making or profiling.
Your data will be stored within the EU as much as possible. If we work with service providers outside the EU, we have put in place the necessary safeguards to ensure that they secure your data appropriately and that you can always exercise your privacy rights.
Fairville will never use your personal data for commercial purposes ('direct marketing'). Under no circumstances will your identification and contact details be shared with third parties for commercial purposes if you have not given your explicit consent. You can change this permission at any time via the application.
You can exercise your other rights in the settings of the application, where you can view, correct or destroy your data. 1. The controller
The person responsible for the processing of your data is Fairville NV, with registered office at B-9810 Nazareth, Steenweg 154, Nazareth registered in the Crossroads Bank for Enterprises under number BE 0756. 963. 452 (RPR Ghent, Ghent division) (hereinafter referred to as"Fairville"or "we").

2. The processing of personal data
By "personal data" we mean any information about an identified or identifiable natural person ('the data subject'). By "processing" we mean an operation or set of operations on personal data or a set of personal data, whether or not carried out by automated means, such as collection, recording, organizing, structuring, storage, updating or modification, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction of data.
3. What personal data is collected for the purpose of processing and how do we process this data?
At Fairville, we ensure that your personal data is processed in an adequate, relevant manner and is limited to what is necessary in accordance with the law. What personal data Fairville collects about you depends on who you are:
As a user of Our City App
In order to manage your profile data, Fairville processes the following identification data:

The content information ("content") that you as a user forward via Our City App to other users or customers (such as traders, associations or local authorities) will not be further processed by Fairville - in other words, the only 'processing' on the part of Fairville is the communication of this content to your addressee. If this content also contains personal data, the recipient may, where appropriate, act as 'controller'. More information about such data processing can be found in the privacy statement of the addressee concerned.
As a registered user of our websites
As a registered user of our Websites, Fairville will also manage your profile data. These only include your name and your e-mail address.
The content information ("content") that you as a user forward via the website to other users or customers (such as traders, associations or local authorities) is not further processed by Fairville - in other words, the only 'processing' on the part of Fairville is the communication of this content to your addressee. As a customer
Fairville's customers are traders, associations, local authorities, healthcare providers, etc. who use Our City App and/or the website for their communication with users.
Fairville records the following personal and electronic identification data of the customer (where the customer is a natural person) or of the natural persons specified as contact persons for the customer (where the customer is a government or legal entity):
- Name
- E-mail address
- Telephone number
- Credit card details.
This data is used by Fairville for its financial administration (invoicing, follow-up of payments and outstanding debts, etc.) and for its customer management in general.
4. For what purposes do we process your personal data?
Fairville only collects and uses personal data for specific, explicit and legitimate purposes and will therefore not use data in a way incompatible with those purposes.
As indicated above under section 3, Fairville (as 'data controller') processes the personal data of the users of Our City App and/or the website solely for the purpose of managing the profile data of the users. In addition, Fairville (as 'controller') only processes personal data of its customers (or of the contact persons at its customers) in order to enable the financial administration and follow-up of these customers.
The legal grounds on which the aforementioned processing operations take place are:
- Necessary for the execution of an agreement. Your personal data will be processed for the execution of an agreement that you have concluded with Fairville; this is the case for the processing of your personal data as a customer of Fairville.
- Permission. Fairville will ask permission to use your personal data for certain purposes (such as for sending messages via Our City App). This is the case for the processing of your personal data as a user of Our City App or of the websites. If we process your data on the basis of your consent, you can withdraw it at any time. If we use your data for marketing purposes, you can always ask to stop this processing. More information about your rights can be found in section 7.
5. With whom is your personal data shared?
Your personal data may be shared with third parties who (1) provide specific services to us or (2) use Our City App or our websites as a customer to send you information about their products and services. In addition, your personal data may be passed on in a number of specific situations that we explain below.
Service providers

- Google Cloud Platform: for hosting our virtual servers
- 3P,Topdesk, Green Valley: for delivering the so-called notification cards
- Campaign Monitor: for managing the e-mail addresses (subscriber lists) and sending newsletters or direct marketing.
- Other third parties who provide services on our behalf and according to our instructions, such as independent consultants. We ensure that these third parties only have access to your personal data to the extent that this is necessary to perform their tasks and that they have undertaken to process the data in a secure and confidential manner and to process them only in accordance with our instructions.
Clientele
Third parties who are fairville customers and who wish to send you information about their products and services may only do so via push notifications you receive from Fairville if you are registered for them, or via the news feed in Our City App or our websites.
Mandatory transfers
In certain cases, we are obliged to pass on personal data about you. This is the case when the law, a regulation or legal process (such as a court order) obliges us to do so or government authorities request it in the context of actions to enforce the law. We may also believe that, in order to prevent physical damage or financial loss or in connection with an investigation into alleged or actual fraud or illegal activities, it is necessary or desirable to disclose data about you.
Other cases
If all or part of our business or assets are sold or transferred, we reserve the right to also transfer all data about you. In that case, we will make the necessary efforts to inform you about this and to ensure that the transferee uses the data you have provided to us in a manner consistent with this Privacy Policy. In the event of such a transfer, you should contact the transferee for questions about the processing of the data.
6. Transfer of data abroad
It may happen that we transfer your data to servers in a country other than where you live or to parties affiliated with us in other countries in order to be able to process personal data on our behalf or have it processed on our behalf. By providing us with the information relating to you, in particular by using this website, you agree that we may transfer the data abroad in this way, which is usually also part of the performance of the agreement we have with you. We always do this in accordance with the terms of this Privacy Statement and the applicable data protection regulations. 7. Your rights
Guarantee of lawful and secure processing of personal data
Fairville always processes your personal data fairly and lawfully. This includes the following guarantees:
- Your personal data will only be collected and processed in accordance with the described and legitimate purposes of this privacy statement.
- Your personal data will only be collected and processed insofar as this is sufficient, relevant and not excessive.
- Your personal data will only be stored for as long as this is necessary or useful for the described and legitimate purposes of this privacy statement.
The risks of accidental or unauthorized destruction, accidental loss, modification of or access to, and any other unauthorized processing are therefore reduced to a minimum. In the event of a burglary of its IT systems, Fairville will immediately take all possible measures to limit the damage to a minimum.
Right of access/rectification/erasure of your personal data
If you prove your identity, you have a right to obtain from Fairville a definitive answer as to whether or not your personal data are processed. When Fairville processes your data, you also have the right to inspect this personal data. You have the right to obtain information about the processing purposes, the categories of personal data that are processed, the recipients of the personal data, the criteria for determining the period during which your personal data will be stored and the rights you can exercise in accordance with the GVA. If you wish to use your right of access, Fairville will comply with this within one (1) month after receiving the request. The request is made by registered mail or via info@fairville.be.
Inaccurate or incomplete personal data can always be corrected. It is up to you as a user to first of all adjust inaccuracies and incompleteness in the settings of the application or on the user profile on the websites. In addition, you can exercise your right to rectification by providing a statement to Fairville. Fairville will comply with this within one month of receiving such a statement.
In addition, you have the right to have your personal data deleted by us without unreasonable delay. You can only invoke this right in the following cases:
- When your personal data are no longer necessary for the purposes for which they were collected or processed;
- When you withdraw your consent and there is no other legal basis for the processing;
- Where an objection is made to the processing and there are no compelling legitimate grounds for the processing;
- When the personal data have been processed unlawfully;
- When your data must be deleted in accordance with a legal obligation.
Fairville assesses the presence of one of the aforementioned cases.
Right to restriction/objection to the processing of your personal data
You have the right to obtain a restriction of the processing of your personal data:
- During the period that Fairville needs to verify the accuracy of the personal data, in case of dispute;
- When the data processing is unlawful and you request a restriction of the processing instead of the deletion of the personal data;
- When Fairville no longer needs your personal data for the processing purposes, but you need the personal data for a legal claim;
- During the period necessary for Fairville to assess the presence of the grounds for erasure of personal data.
You also have the right to object to the processing of your personal data at any time for the reasons relating to your particular situation. Fairville will then cease the processing of your personal data, unless Fairville can demonstrate compelling legitimate grounds for the processing of your personal data that outweigh your right to object.

Right to data portability
You have the right to obtain the personal data provided to Fairville in a structured, commonly used and machine-readable format. In addition, you have the right to transfer this personal data to another controller if the processing of your personal data is solely based on your consent.

Right to withdraw my consent/right to lodge a complaint
You have the right to withdraw your consent at any time. In addition, you have the right to lodge a complaint regarding the processing of your personal data by Fairville with the Belgian Data Protection Authority.

8. Security of your personal data
We ensure that your personal data is protected by appropriate, technical and organizational security measures against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use. Specifically, your personal data are protected, among other things, by the following technical security measures: Technical access controls; Encryption; Anti-virus scans; Logging of data; Backups. Specifically, your personal data is protected, among other things, by the following organizational security measures: Physical access controls, for example via badges, security guards; Policies and procedures described in our security policy; Confidentiality clauses or contracts with our employees, consultants, service providers.
9. Links to other websites
Fairville's applications and websites may contain links to websites operated by companies outside of Fairville. Those other websites have their own privacy statement that you should read carefully when you surf there. Under no circumstances can Fairville be responsible for the content of those websites nor for any processing of personal data by these third parties.
10. Updating this Privacy Statement
This Privacy Statement is updated regularly to reflect Fairville's data use. You will not be informed of this in advance. Any adjustments will be brought to the attention of fairville's websites and via the applications. At the top of this statement you will find the date of the last update.
